1. Agreement to Terms

By accessing and using Apex and Exit ("the Service"), you accept and agree to be bound by these Terms of Service. If you do not agree, please do not use the Service.

2. Use License

Permission is granted to access and use the Service for personal, non-commercial purposes only. Under this license you may not:

• Modify or copy the materials;
• Use the materials for any commercial purpose or public display;
• Attempt to decompile or reverse engineer any software contained in the Service;
• Remove any copyright or other proprietary notations from the materials;
• Transfer the materials to another person or mirror the materials on any other server.

This license terminates automatically if you violate any of these restrictions and may be terminated by Apex and Exit at any time.

3. Accounts

3.1 Account Creation

Creating an account is optional. You may use the Service without an account; in that case, your data is stored only in your browser's local storage. If you create an account, you agree to provide accurate and complete information and to keep your credentials confidential.

3.2 Your Responsibilities

You are responsible for all activity that occurs under your account. You agree not to share your account credentials or allow others to use your account. You must notify us immediately at support@apexandexit.com if you suspect unauthorized access.

3.3 Account Termination

You may delete your account at any time from your Account Settings page. Deletion permanently removes your account and all associated data. We may suspend or terminate accounts that violate these Terms, that are used for abuse or unauthorized access attempts, or that have been inactive for an extended period following notice.

4. Acceptable Use

You agree not to use the Service to:

• Attempt to gain unauthorized access to any part of the Service or its infrastructure;
• Scrape, crawl, or systematically extract data from the Service in a manner that places unreasonable load on our servers;
• Submit false, misleading, or fraudulent information;
• Violate any applicable local, national, or international law or regulation.

5. Data Collection and Privacy

Your use of the Service is subject to our Privacy Notice, which is incorporated into these Terms by reference. If you create an account, we collect and process personal data as described in the Privacy Notice, including email address, display name, and optionally data from your linked iRacing account. We do not sell your personal information.

6. Disclaimer

This site is not affiliated with, endorsed by, or connected to iRacing.com Motorsport Simulations, LLC. All trademarks, service marks, and company names are the property of their respective owners.

The materials on Apex and Exit are provided on an "as is" basis. Apex and Exit makes no warranties, expressed or implied, and hereby disclaims all other warranties including, without limitation, implied warranties of merchantability, fitness for a particular purpose, or non-infringement of intellectual property.

Apex and Exit does not warrant the accuracy, completeness, or reliability of any schedule data or other materials on the Service. iRacing schedule information may change without notice.

7. Limitations of Liability

To the fullest extent permitted by applicable law, Apex and Exit shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of data, loss of profits, or business interruption — arising out of or related to your use of or inability to use the Service, even if advised of the possibility of such damages.

8. Accuracy of Materials

The materials on Apex and Exit may include technical, typographical, or data errors. Apex and Exit does not warrant that any materials are accurate, complete, or current, and may make changes at any time without notice.

9. Links

Apex and Exit has not reviewed all sites linked from the Service and is not responsible for the content of any linked site. Inclusion of any link does not imply endorsement. Use of any linked website is at your own risk.

10. Modifications

Apex and Exit may revise these Terms at any time. Updated Terms will be posted on this page with a revised "Last Updated" date. For material changes, we will make reasonable efforts to notify registered users by email. Continued use of the Service after the effective date of changes constitutes acceptance of the updated Terms.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Colorado, United States, without regard to its conflict of law provisions. You agree to submit to the personal jurisdiction of the courts located in Colorado for resolution of any disputes arising under these Terms.

If you are an EU consumer, nothing in this clause limits your right to bring proceedings in the courts of your country of residence or to benefit from mandatory consumer protection laws in your jurisdiction.
